, apply to Fletcher Baseball, LLC to participate in the Tournament to be conducted in Louisville, KY , currently scheduled to begin on or around July 9, 2007 and end on or around July 14, 2007 (“Tournament”). I acknowledge and agree to, and represent, the following for myself and my child, in consideration of the opportunity to be provided by the FB (contingent upon its agreement to my child’s and/or my participation).
Acknowledgment of Risks. I acknowledge that participating in the Tournament involves risks of serious damage and harm to persons and property, and even death, and my child and I assume those risks, including risks arising from acts or failures to act of the FB.
Information Relied on by FB. I am the parent or legal guardian for the child for whom this document is signed. My child (and/or I) is in good health and sound mind. I have or will discuss my child’s (and/or my) participation in the Tournament with my physician. My child (and/or I) will participate in the Tournament only if I have received my physician’s approval and believe that my child (and/or I) is able to participate without harm. I acknowledge that FB will not assess or approve my child’s or my fitness for participation. I am under no force or duress of any kind to compel my child’s or my participation in the Tournament or my signing of this document.
Release and Indemnity. THIS DOCUMENT IS INTENDED TO ABSOLVE FB OF ANY LIABILITY TO ME OR MY CHILD THAT IS RELATED TO MY CHILD’S OR MY PARTICIPATION IN THE TOURNAMENT. Accordingly, I hereby release FB from, waive, and will never sue FB for, any damage (whether damage to or loss of property, finances, life, body, mind, or emotions), cost, suit, demand, claim, or other liability, that arises or is alleged to arise from or in connection with my child’s or my participation in the Tournament. Such liability includes any liability that arises or is alleged to arise from FB’s negligence (but not its willful and wanton misconduct). Such liability also includes any liability that arises or is alleged to arise from claims for contribution by another that my child or I have sued or from whom my child or I have received compensation.
Medical Permission. I give my permission for me or my child to be provided emergency and first aid treatment for illness or injury sustained while participating in the Tournament, including by the administration of emergency anesthesia or surgery; and authorize the adult leaders of the Tournament to act on my behalf in ordering such treatment.
Accommodations. I understand and acknowledge that, as a condition of my child’s participation in the Tournament, all overnight accommodations must be arranged through FB’s approved housing bureau. I understand and acknowledge that FB’s approved housing bureau is a separate entity from FB, and FB has no responsibility or liability for problems arising from accommodations or lack thereof.
Photograph Release. I, on behalf of my child, grant FB, its employees, agents, successors, and assigns, an irrevocable, nonexclusive, and nontransferable worldwide license to use my child’s photograph, including the right to publicly display the image thereon, and the right to make derivative works from the original photograph, for all purposes, including the right to broadcast or display the image(s), and/or the derivative works thereof, via airwaves, cable, internet, or other means, one or more times, on a commercial or noncommercial basis. I understand that FB will not publish any personally identifiable information about my child, and will not use my child’s image in association with any products or services that would be illegal, inappropriate for minors to use or view, or otherwise offensive to the general morals of the community, including but not limited to use in promotion of sexually explicit products or services, tobacco products, and alcoholic beverages. I acknowledge that FB we will have the right to use and license others to use (e.g. web hosting providers, advertising agencies, etc.) the image in the endorsement of any product or service for the benefit of FB.
Definitions. (a) References to “me,” “my,” and “I” shall include and bind my spouse, any parent of the child for whom this document is signed, any guardian or other person with responsibility for the care and supervision of such child, and any insurer, heir, estate, legal representative, executor, administrator, successor, or assign of me or such child. (b) “Participation” or “participating” in the activity includes planning and preparing for, traveling to, and traveling from, as well as participating in, the Tournament. (c) “FB” includes (i) its affiliates, and institutions cooperating in the Tournament; (ii) the employees, contractors, volunteers, and agents of the FB or such affiliate or institution; and (iii) the spouses, insurers, heirs, estates, legal representatives, executors, administrators, successors, estates, and assigns of any of the foregoing.
